HUDSON - Developers of the Coyote Crossing subdivision have filed a lawsuit against Pasco County over limits on the number of houses they can build on their property.
The suit, filed Monday in Pasco County Circuit Court, asks a judge to force the county commission reconsider its decision to place a five-house cap on the 18.81-acre parcel.
Coyote's attorney, David Smolker, did not return a phone call seeking comment, and Pasco County officials were not willing to discuss the litigation over the subdivision.
Magistrate Richard E. Davis issued an order in September, at the request of Coyote Crossing LLC, that petitioned the county commission to increase a cap on the property, northwest of Coyote Road and Kitten Trail, from five to 14 houses.
A previous owner had agreed to the five-house limit in 2005.
In a 3-2 vote, county commissioners rejected the special magistrate's ruling.
County Commissioner Jack Mariano, who represents the Hudson area, has argued the proposal is incompatible with the neighborhood.
The developer and others dispute that, saying the property is designated for as many as 54 houses but was limited by the 2005 cap.
Pasco officials initially recommended against lifting the cap.
The planning commission suggested a 10-unit cap. The county commission voted 3-2 to keep the limit of five.
