Partin Murder Trial Delayed For Blood Testing

NEW PORT RICHEY - The first-degree murder trial of Phillup Alan Partin has been put on hold until Tuesday so the defense can send a blood sample to Raleigh, N.C., for testing.

Partin, 42, is charged in the July 2002 slaying of 16-year-old Joshan Ashbrook. Her broken body was found in woods off Shady Hills Road on Aug. 1, 2002.

At issue in the delay is a blood spot investigators found on the pavement of Shady Hills Road. Prosecutors had the blood tested, but analysts found insufficient DNA for comparison.

Defense attorney Bill Bennett said he wasn't aware of the test or the results and that he would have had defense experts conduct further testing had he known. He said the blood could go directly to the defense's theory of the case if it turns out to be Ashbrook's.

The trial is set to continue Tuesday afternoon in Pasco Circuit Court.
