Broncos RB Henry Disputes Drug Test Result

Published: October 5, 2007

ENGLEWOOD, Colo. - Broncos running back Travis Henry, the league's leading rusher, is trying to prevent the NFL from suspending him over the results of a drug test, Newsday reported Thursday.

Henry was granted a temporary restraining order in Suffolk County (N.Y.) Supreme Court to prevent the league from using a urine specimen against him and to prevent the league from disclosing the test results, but an appellate court vacated the order, according to court papers filed in Brooklyn federal court.

The report on the newspaper's Web site said Henry claims the league violated its substance abuse policy by not allowing his experts to be present for testing of his urine sample, according to court papers.

Pending an appeal, Henry would be subject to a yearlong suspension if he tested positive again. While in Tennessee, Henry was suspended four games in September 2005 for violating the league's substance abuse policy.

He signed a five-year, $22.5 million free-agent contract with the Broncos after the Titans released him in a cost-cutting move.

The Broncos declined comment Thursday.

Delhomme Still Not Practicing For Panthers

CHARLOTTE, N.C. - David Carr appears likely to make his second straight start at quarterback for the Carolina Panthers after Jake Delhomme missed practice again Thursday.

While Coach John Fox would not identify a starter for Sunday's game at New Orleans, Delhomme hasn't thrown a football since straining his right elbow on Sept. 23 against Atlanta.

Union Lawyer Argues Vick's Bonus Is Protected

PHILADELPHIA - NFL Players Association lawyers argued Thursday that the league's collective bargaining agreement protects Michael Vick from the Atlanta Falcons' attempts to be refunded up to $22 million in bonus money.

A decision is expected by Oct. 12, said Stephen B. Burbank, the University of Pennsylvania law professor and special master who led the arbitration hearing.

The Falcons argued the suspended Falcons quarterback knew he was in violation of the contract when he signed the $130 million deal in December 2004, and that he used proceeds from the deal to fund his dogfighting operation.

New York-based attorney Jeffrey Kessler, who represented Vick and the NFLPA, countered that the CBA extension agreed to last year prevents forfeiture of bonus money even if the player contract says otherwise.

In pleading guilty to a federal conspiracy charge Aug. 27, Vick admitted helping to kill six to eight dogs, among other things. He faces up to five years in prison and will be sentenced Dec. 10 on the federal charges. He also faces state felony charges in Virginia.

BEARS: Linebacker Lance Briggs will be under court supervision for a year and must pay $485 in fines for leaving the scene of an accident.

Briggs did not immediately call police after crashing his Lamborghini and abandoning it alongside an expressway on Aug 27.

Briggs pleaded guilty Thursday to leaving the scene.

49ERS: Left tackle Jonas Jennings will be out of the lineup indefinitely while dealing with a 'private matter,' Coach Mike Nolan said.

LIONS: Placed running back Brian Calhoun on injured reserve with a season-ending knee injury and re-signed running back Aveion Cason.

REDSKINS: Running back Clinton Portis proclaimed himself healthy enough to play after Thursday's practice, but wide receiver Santana Moss missed practice again because of a groin injury and remains uncertain about whether he will play Sunday against Detroit.

DISABILITY DISPUTE: Mike Ditka and other former pro football players kept up their attack on the NFL Players Association on Thursday. Led by the Hall of Famer, they again criticized the union for what they claim is a strategy to discredit disabled retired players trying to get disability benefits.
