HOLIDAY - They met through a friend.
He was 25. She was 15.
But he was told the girl was 18, and she didn't tell him her real age. Not that his ignorance to her real age matters, according to the law.
He called her to ask her to hang out. At first, he was told she was out of town. Persistent, he called the next day, picked her up and took her to his house, Pasco County Sheriff's Office reports states.
That's when deputies say the crime began.
Justin Lee Colby and the teen had sex that first day in January and then about 50 more times - just about every time they got together - from then until Aug. 22. Florida law doesn't allow a girl that young to consent to sex.
The girl told deputies she used drugs with Colby including crack, cocaine, Dilaudid and OxyContin, and he injected her with some sort of drugs, according to a report.
Her name is being withheld because of the nature of the case.
The girl's grandmother, who has custody of her, told deputies she found out her granddaughter was dating the older man in March and told Colby to stay away from her, a report states.
In June, the girl's guardian sought and got a sexual violence injunction against Colby prohibiting him contact with the teen, court records filed in Pasco Circuit Court show. The protection order banned him from going within 100 feet of the girl's vehicle; 50 feet from her; and within 500 feet of her school and home.
In July, Colby was arrested by deputies on charges he violated the injunction. He was released the next day after assuring a judge he would show up for future court hearings.
On Sept. 4, the girl's guardian reported to deputies that Colby violated this order. A witness stated that after his release, Colby had contact with the girl in person, on the phone and by text messaging, a report states. The witness told deputies Colby 'made' the girl take drugs, including IV drugs, a report states.
On Sept. 1, Colby was arrested on a charge of possession of a controlled substance without a prescription. A few days before that, the teen was placed into a mental health facility, a report states.
It was unclear Thursday whether the teen was still in a treatment facility.
Colby, of 3302 Glenwood Circle, was being held at the Land O' Lakes Jail on a new charge of lewd or lascivious battery and some previous charges such as sale of a controlled substance, aggravated assault and violation of a domestic violence injunction. Bail was set at $136,500.
