Polk County Sheriff Grady Judd today released a portion of a video of what he described as the "animalistic" beating of a 16-year-old girl by other teenagers.
Victoria Lindsay received a concussion, damage to her left eye and ear, and numerous bruises during the March 30 beating in Lakeland, which lasted about 30 minutes, the sheriff's office has said.
Judd said Lindsay still hasn't recovered full vision in her left eye or full hearing in her left ear.
According to one of the eight teenagers the sheriffs office charged in connection with the beating, Lindsay had been speaking ill of the other girls on her MySpace page. One of the teenagers told investigators they intended to record the beating on video and post it on MySpace and YouTube as retaliation, Judd said.
Judd said he would not release the tape in its entirety because that would fulfill the teens' aim. However, he thought it important to release a segment because "There's also the concern that we need to educate the parents about what their kids are doing."
Judd also said he thought YouTube, MySpace and other social networking sites have moral, ethical and perhaps legal obligations not to post videos of such fights. "It makes it cool and it creates copycats," Judd said.
The video shows Lindsay being beaten at 6124 Calendar Court W. and her attempts to escape being blocked, a sheriff's office report states.
According to the report, Lindsay told investigators the girls taunted her during the beating, saying they were going to post video of the attack on YouTube and MySpace.
But the mother of one of the girls said Lindsay had provoked the other teens by threatening and insulting them on the MySpace social-networking Web site.
"She embarrassed these girls," Christina Garcia told News Channel 8 in an interview. "She said she was going to kick their you-know-what's, and how slutty they are, and calling them much worse names than sluts."
Investigators last week charged eight teens in the assault: six girls — including Garcia's daughter, Mercades Nichols, 17, — whom they say beat Lindsay and two boys whom they say acted as lookouts. All are charged with felony battery and felony false imprisonment.
Three of the girls, including Nichols, 17, are also charged with felony kidnapping. The other two are Brittini Hardcastle, 17 and Britney Mayes, 17.
One of the boys, Stephen Schumaker, 18, of 6020 Calendar Court W., is free on $5,000 bail after being booked into the Polk County Jail, records show. The other teens were booked into the county's juvenile assessment center.
Lindsay had been staying at the home of Nichols' grandmother during spring break. About 8 p.m. on March 30, while the grandmother was at work, Hardcastle and Nichols called and sent text messages to Lindsay saying they wanted to talk to her at the house, Judd said. "What she didn't know was there were four other girls hiding in there."
At the house, Hardcastle and Nichols yelled at Lindsay, who went into a bedroom, Judd said. There, 14-year-old April Cooper struck Lindsay several times in the face and slammed her head into the bedroom wall, knocking her unconscious while the others took video the beating, Judd said.
When Lindsay awoke, she was on the couch in the living room, surrounded by Cooper, Nichols, Hardcastle, Mays, as well as Cara Murphy, 16, and Kayla Hassell, 15, Judd said.
The video clip Judd showed began with Lindsay on the couch and Hardcastle yelling and striking her. Lindsay got up and said, "You want me to leave; I'll go home." But the girls said she wasn't going anywhere. Hardcastle continued to hit Lindsay, while saying things such as, "Fight back! You have to fight back!" and, "What, you gonna cry like a little girl?"
Judd said there was no evidence on the video that Lindsay tried to fight back.
At one point, Lindsay backed into a corner by the front door near a glass bookcase holding knickknacks. "Don't hit the shelves! Don't hit the shelves!" Nichols yelled.
The other girls yelled for Lindsay to fight back, saying, "It's perfectly fair! It's one on one!"
Before the clip ended, Murphy, who was operating the video camera, said, "There's only 17 seconds left. Make it good."
Judd said investigators analyzed the video frame-by-frame and found other portions where the girls took turns striking Lindsay while others held camera phones or the video camera.
The grandmother was mortified by what had occurred and is cooperating with law enforcement.
Schumaker's father, Robert, denied his son's involvement in the incident, saying neighbors had told the Schumakers that Stephen and the other boy were not at the house acting as lookouts.
Garcia also denied that the other boy, Zachary Ashley, 17, was involved in the incident, saying surveillance video from his job can prove he was at work.
Asked about the boys' claims they were not there, Judd said one of the boys stuck his head in from outside and told the girls to quiet down because neighbors could hear the fight.

Garcia said she was ashamed her daughter hadn't called the police, but she also thought the Internet was to blame. She said children shouldn't get online and say bad things about each other.
"That's a recipe for disaster," she said.
Judd said after the teenagers were arrested, they were laughing together in a holding cell, saying, "Am I going to miss cheerleading practice?" and "I guess we're not going to the beach this week."
"That absolutely makes my blood boil," Judd said. "It's incumbent upon us as a society not to accept this."

Why is it necessary to release this video? Do we really need to see the beating this poor girl was given?
I don't care who said what about whom. This was a senseless act of violence and I personally do not care to view the childish videotaping of it.
It's bad enough this girl lived through it once in the presence of these monsters. Does it really have to be shown to everyone else?

No matter what this poor kid said to them verbally and online - doesn't mean that it is necessary to beat the cr@p out of her physically. And 6 on 1? Yeah gotta love those odds.
I really hope the kids and the parents grow up after this. Including the 16 year old once she heals, not that she deserved it in any way but just learn to let things roll off her shoulders and not provoke people that don't know how to control themselves.
I'm glad they're all being charged. Kids are out of control these days, ready to beat people at the drop of a hat.

These girls are just plain stupid! Blaming the internet - jeez, isn't anyone responsible for anything these days. These girls took it upon themselves to escalate a verbal altercation into a physical altercation. This was a pre-mediated act of violence and should be charged as such. What a waste of life and space!

Way to go, Christina Garcia. You just missed out on an opportunity to teach a lesson to your daughter. Insulting words and names have power only if you let them, and all of you did exactly that. The mother of one of the attackers claim the victim brought the beating onto herself because she called the others bad names. Looks like the shoe fits. I also agree that there is no reason this video should ever been shown anywhere but in court.

Come on, there's no reason to release this video. Everybody involved has been charged. It's not like the video is needed to make IDs. Just charge these SAVAGES with the crimes they committed and be done with it.

Thanks for the video, I have a problem with the 6 against 1, and when the girl was trying to leave they would not let her, I hope the charge them with kidnapping because of that. Also we all had fights growing up, if anyone here denies that well they just telling lies. But to show the other girls faces and not the one beaten only brings more ridicule for this poor girl. She will be teased every day at school for this. Who knows how long the emotional scares will last. They should have blocked out all faces.

This is EXACTLY why the State Attorney's office needs to make an IMMEDIATE decision to charge these useless wastes of space as adults. They wouldn't find their actions so funny when they are being booked into the county jail as opposed to being dropped off at the juvenile assessment center(a.k.a. camp for bad girls & boys). You act like an animal, you get locked up with the other animals. As far as the so-called "parents"- they should be facing charges of their own. Kids don't do things like this unless they are unsupervised, undisciplined, and basically raised to take no responsibility for their actions.
The kids of today have spent every waking moment being rewarded for every single thing they should be expected to do and they are taught that whenever they do something wrong, it wasn't really their fault...someone/something else made them do it. What's so sad about this is that Lindsay was staying at her so-called friend's house because of problems in her own home. And instead of finding refuge, she had been clearly set up by these "friends" and got a beating by them! I wonder if these teen girls are still locked up in Juvenile Detention. I hope they are and crying for their mommies after they stopped chuckling about missing cheerleading practice and the beach. Speaking of motherhood, Mrs. Garcia, are you seriously trying to justify your daughter's actions by claiming she was so terribly provoked? Your daughter and her friends acted like a pack of animals by beating a defenseless girl because of silly name-calling and trashing that most teenagers do. Bad parents make bad kids. Kids need to be made to understand that acting like animals by hitting and screaming at others is never an acceptable way to solve issues. Issues and problems are part of life, and until kids understand this, they cannot function effectively in normal society.
What a pity that Christina Garcia is such a poorly equipped parent. Her immature excuses for this show that she is indeed a very poor parent. Her pathetic example will be taken to heart by at least some of these kids, and even some of the readers of this article. It essentially tells kids that there is no order in society - jungle law is the real law. She is a failed parent.

Taking part in something like this does not mean they are "hicks" "hillbillies" or "red necks" it just means they are stupid and ignorant. Being country does not make a person bad any more than being black, female or hispanic makes people bad.

They should make the parents of the abusive kids watch the video.. right after they tell them that they will be paying for the girl's full medical bills, cost to the legal system, and any other expenses that occur.. Stories like this scare me to death. I remember being picked on as a teenager but nothing like this horrible violence occured when I was growing up. I have a 6 year old daughter and this scares the crap out of me for her teenage years. I know as parents we can hope we teach our kids how to avoid this but lately it seems like a trend among teens. I don't agree with home schooling kids because I think they need that interaction to learn for the future but everytime I read things like this it makes me start to want to.

I'm sure the future employers who are going to question the felony conviction on your record are going to love your story of 7 of you ganging up on one girl because "She said something bad about me." They will really want to hire you with that attitude. You all just screwed yourselves out of college, jobs and respect. Congratulations. All for 15 minutes of what you consider fame. This is why PARENTS are supposed to be parents. Why are there so many parents out there that feel the "Oh, well, teenagers are all crazy these days" philosophy is a way to be? Stand up and raise your kids - they are YOUR responsibility until they are 18 - not the rest of society. I feel the parents need to be videotaped as they pay the court costs and fines these great kids are racking up (I would prefer charges on the parents for neglect as well, if the use the internet is so unmonitored by them that this can develop), and that should be the video we see, not this junk. Nothing is impressive about 7 girls beating on one girl. They look like cowardly fools, and they are. I'm so glad we can all look forward to paying their welfare for the rest of their lives since they "don't know no better." They are not going to get any better if their parents don't even realize how disgusting this behavior is.

Wow, they're trying to look like a bunch of bada$$es! Somebody PLEASE let them loose in General Population so they can prove just how tough they really are. And as for these pathetic, unfit breeders, I mean parents, I hope to God you don't have anymore offspring at home. We don't need your evil seed running around beating on people just because they got their poor widdle feewings hurt...
To think that you can seriously attempt to place blame on the Internet is just beyond comprehension! Why weren't you monitoring your spawn's MySpace page? Why weren't you discussing the situation with them? If all of you "parents" had a problem with the victim, why didn't you try to resolve it before things got out of hand? Oh, I'm sorry, that wasn't YOUR responsibility, was it? The school/internet/MySpace/system was supposed to handle the care and discipline for your little angels because you were too busy living your own life, right? I guess you missed the memo that said you have the DUTY to raise YOUR offspring in a good and decent manner. WHAT'S WRONG WITH YOU??? Why, oh why, are stupid people allowed to breed (esp Ms Garcia)? Get out of the friggin' gene pool and leave the procreating to those of us from the deep end. You're obviously from the very, very shallow end of it.

I think that the video should have been released because it sure got me fired up! The punishment should fit the crime and a good public caining is in order here.

This was a Premeditated Crime, planned and executed to commit assault & infict serious bodily harm on another person. This is a very serious crime and with holding someone against their will added this was not just a teen misunderstanding, but dangerous situation. Not only are there criminal charges there could be a civil suit filed by the injured girl for physical and emotional damages. A traumatic ordeal as she as experienced can have long term affects. All in all the teens involved is this senseless event should be punished to the full extend of the law as adults and serve time for their violent attack.

WOW i dont know who is worse, the parents or the teens. How can you even think of saying anything that makes whatever they wrote on "Myspace" right???? I would've told the cops to keep my daughter inside for about a couple of weeks so she can learn her lesson, that you DO NOT turn words on an internet site into such violence. I mean sum of these girls are 17 for crying out loud. What kind of F*&%$#% mentallity do they have!! Just so D$%# sad!

These teenagers should be prosecuted to the fullest extent of the law, and tried as ADULTS! It was clearly 100% pre-meditated and meticulously planned and thought out. The victim will be affected emotionally by this for a very long time. Regardless of their "reasons" for doing this, taking the law into one's own hands is not acceptable. It appeared on the video as if they really enjoyed torturing her. Put these people away until they are old and gray!

The following quote was spoken in reference to the alleged insults posted by the victim on myspace.
Garcia:
"I don't see why she (the victim) would do that if she didn't have the nerve to back up what she was saying" '
This was from NBC's coverage of this.

Ms. Garcia's response to what her daughter has been involved in is appalling.
Unfortunately it seems to be a growing outlook as far as raising a child and parenting is concerned.
I'm never really shocked any more to see what is on the news these days, I wonder what things are coming to.

Somehow I don't think we are following the rules here. We must not hate and lets try to treat these young people with more respect. We must somehow find it within our selves to forgive these misguided youths and find alternative outlets for them to vent there frustration with how bad there lives are. We as a society must do a better job in guiding our youth in becoming positive and productive citizens. YEA RIGHT, Put the little rat t*rds in jail where they belong and lets have DCF work on the dirtbag parents for letting this happen.

I can't believe how many ignorant adults or brainless teenagers are trying to rationalize the conduct of these thugs by saying the victim "talked out" or "had threats on her blog".
What the hell is wrong with you people? Sticks and stones . . . remember when you were, like, 5-years-old? It still stands when you're an adult or young adult.

Yes the little wastes of breath need to be tried and convicted as adults. Mrs. Garcia should be tried as an accessory.
I had to suck it up wehn bullies beat me all the way through high school in the 70's and to this day I think, then as now, bullies like this should be taken out back and disposed of as they are no further use to society.

if any of my kids would do anything like this, they would have to ask the police to keep them in jail for there safty, because they would not like to be at home with there mom and dad and think that everthing is okay. i hope the girl will be okay. i am sorry this happen to your child. nobody deserves this. I have sat here and read all of your comments and i honestly can not believe some of you. Everyone talks about right and wrong. Most of you are ganging up on others by what they wrote. Everyone is entitled to their own opinion. Honestly if you don't like a comment from someone move on don't make it a point to bash them. I have my own opinion about some of these comments but that just shows what type of person they really are. By you singling them out and responding by insulting them you are making a wrong decision yourself. LEARN WHAT IS RIGHT AND WHAT IS WRONG JUST BECAUSE SOMEONE ELSE DOES IT DOESN'T MEAN YOU HAVE TO.

As far as what happened in this article i have to say it doesn't shock me because i do know how mean people can be. The parents can only parent their children so much. After a certain point the child will start to make their own decisions. Every person is their own person. The ones who were beating up the victim are to blame for their own actions because they made the choice and premeditated what they were planning on doing to the victim. They had plenty of time to think about what they were going to do and they still followed through with it. No one forced them to do it they each did it on their own free will. The others who just stood around and watched did the wrong thing by doing nothing to stop it. They are much at fault as the ones who physically hit the victim. They should be punished and i believe tried as adults because not only was it premeditated but they held her hostage in the home while some of them (from what i saw) took turns beating her. (From what i read) after she regained consciousness they continued to beat her knowing they hurt her to the point of her losing consciousness in the first place. They also drove her to another location and threatened her again showing they have no problem doing it again. I understand she may have posted a blog on myspace but the point is she used words not physical violence to voice her opinion. They retaliated with physical violence. THERE IS A DIFFERENCE. In case you didn't notice while Victoria was trying to leave the house and the other girl blocked the door and started beating her another girl said don't hit the shelves don't hit the shelves. Which is so unthinkable to me how she was so concerned about a material thing in the house then a human being who was thought to be one of her friends getting beat up. Also myspace and youtube are websites and do not force a person's decision on doing something bad or wrong. Blaming music, tv, or the internet is not going to solve anything because each person is going to make their own decision whether we have these luxuries or not. I also want to say my prayers are with Victoria and her family.

That was the sickest display I have ever seen..and the sad part is that TV has aired the thing..These animals got even more exposure than they could have hoped for..The news made stars of them. In the eyes of their peers, who think this kind of sick crap is "Cool"..I think this MY Space breeds nothing but porn,sex,and this kind of action..SHAME ON YOU MY SPACE..Not that I think the owners of the web site really give a crap.This will make them more popular.You know what I think would have been the right thing for TV to show..Is the 8 rotten,obviously out of control,brats being arrested. I think ALL 8 should be under some kind of house arrest and do a whole summer of community service..not to mention I think ANY and ALL hospital and medical bills should be paid for by the parents of these animals..This is an example of children with out discipline and an example of very poor parenting. I raised my children to respect others and to stick up for them selves if someone attacked them..If one of my children had been involved in something like this there would have been hell to pay..It would have been the worst summer of their life, but hay we all know in order to pull off a punishment like that..it would be an inconvenience for the "Parents" work and social life, ..OMG we can't have that happen... Makes me sick to know that this will not be the last person these sick stupid children will do harm to..Hang Your Head In The Shame that YOU as parents could have probably prevented this attack..If you were being good parents at all..Just think..that bunch of rotten kids will someday be old enough to become..The people who run our country,and other positions of power..God Help Us All....and Ms. Garcia..SHUT UP..You Make Me Sick..NO ONE should be treated that way for a few crappy comments on MY Space..We can see why YOUR daughter has this kind of attitude..Your ALL a bunch of Low Lifes...I hope they try them ALL as adults...

I'm disgusted by the girls and I'm even more disgusted at the parents for not taking blame for their own children's behavior. Even one parent ok'd it? WTF is wrong with society today? Parents just have kids and no longer accept responsibility for them? COME ON.
