TAMPA - The grandparents and father of Summer Moll have worked out a custody agreement.
The 4-year-old girl survived a head-on crash on the Selmon Crosstown Expressway on Sept. 10 that killed her mother, Jennifer O'Boyle.
Summer's grandparents, Tammy and Arthur Rosian, have been in court with Summer's father, Joshua Adam Moll, who had sought custody. A hearing scheduled for this morning was not held because a custody agreement was worked out between the parties.
The Rosians' attorney, Jennifer Reh, said they would have custody of Summer while allowing liberal visitation for her father as much as he is willing "on a transitional basis."
Reh said it will be on a "transitional basis with an ongoing and deepening relationship between father and daughter." The idea is to transition Summer over time from her grandparents to her father's custody, keeping everyone involved in the child's life.
Tammy Rosian said Summer is improving. She has surgery scheduled for Wednesday to treat a head wound and remove pins in her legs. Summer also will receive a cast on her right leg. "She has a lot more strength than you and I," Rosian said. "Her spirits are real high."
She said Summer has her voice back. "She's boisterous and she's very, very bossy." Rosian said.
Rosian added that she was pleased with the agreement.
