Attorney General 'Appalled' By Disabled Inmate Video

TAMPA -- State and federal prosecutors are being called to act after the dumping of a quadriplegic man from a wheelchair by a Hillsborough County jail deputy.

On Jan. 29, video cameras in the Orient Road Jail booking room recorded Detention Deputy Charlette Marshall-Jones, 44, raising the back of a wheelchair and sending Brian Sterner tumbling to the floor. Sterner, 32, of Riverview, was taken to the jail on a warrant stemming from a traffic violation.

Florida Attorney General Bill McCollum is asking his Office of Civil Rights to immediately review the video.

"I have viewed the video of Mr. Sterner's treatment and I am appalled by the situation which so clearly unfolded in these images," McCollum says in a written statement.

The attorney general's office has communicated with Hillsborough County Sheriff David Gee and has been assured of his full support and cooperation, McCollum says.

A sheriff's detective has been assigned to conduct a criminal investigation of the case, sheriff's spokeswoman Debbie Carter said.

An internal affairs investigation is reviewing the actions of Marshall-Jones and three of her supervisors: Cpl. Steve Dickey, Cpl. Decondra Williams and Sgt. Gary Hinson.

Marshall-Jones was suspended without pay, and the supervisors were suspended with pay.

"Because this deals with a disability issue, we think it's worth reviewing as a civil rights matter," said Joe Jacquot, deputy attorney general. "But I'm not sure what we might find or how long this will take."

The attorney general's office showed the video to McCollum as soon as it learned of the video's existence. McCollum's jaw dropped, and he was taken aback after watching it, Jacquot said.

"One of the questions is going to be, 'Is this normal?' " Jacquot said. "Is this something that has happened before? He's wondering if there's training."

Today, J. Willie David III, president of the Florida Civil Rights Association, called on U.S. Attorney General Michael B. Mukasey to order an immediate investigation by the U.S. Department of Justice.

"Forcing any quadriplegic from a wheelchair is certainly inhumane and inexcusable," David said.

To suspend a deputy without pay and place others on administrative leave pending investigation is a slap in the face to the disabled community, he said.

"The actions of these deputies in the mistreatment of Brian Sterner are deplorable, and the sheriff's office should fire and criminally charge these deputies," David said.

On Wednesday, Gov. Charlie Crist said he found the incident "terribly disturbing" and wondered whether there it might be a civil rights issue.

"We're looking into it," he said.

Jails Equipped For The Disabled

Having inmates in wheelchairs is nothing new to the Hillsborough jail system, sheriff's officials said.

Deputies processed about 72,000 inmates at the Orient Road booking center in 2007. At least 230 were in wheelchairs, officials said.

Thirty-one current inmates are in wheelchairs, Col. David Parrish said. He declined to release the names of those inmates, explaining that to do so would violate medical privacy laws.

Parrish has been chief administrator of the sheriff's office's jail division since 1982.

Orient Road Jail was designed in the 1980s and opened in 1990, he said. Some of the housing units there were retrofitted to comply with requirements of the Americans With Disabilities Act. The changes included installation of chairlifts in some of the showers.

Falkenburg Road Jail opened in 1998 and built to meet ADA requirements, Parrish said.

"Either jail is equipped to handle such people," he said. "Falkenburg is more universally accessible because it's all on one level."

Most inmates in wheelchairs are housed together in a pod at Falkenburg, he said.

"I walked into one pod one day and counted 24 inmates in wheelchairs," he said.

Deputy, Supervisors' Records Good

A review of the personnel files of Marshall-Jones and the three supervisors turned up mostly positive performance evaluations and dozens of commendation letters.

Marshall-Jones was suspended twice before without pay, according to her personnel record. In 1988, she improperly conducted an inmate head count and was suspended for six days. Two years later, she was suspended for one day for failing to complete a fire safety and sanitation inspection.

Her last evaluation was written by Hinson two weeks before the wheelchair incident.

In it, the sergeant says Marshall-Jones is an outstanding employee who handles inmates well.

Maj. Robert Lucas, who commands the Orient Road Jail, included this comment in the same review: "Deputy Marshall-Jones knows her job and does it well. [She is] a quality employee in every regard."

Hinson has a perfect attendance record but was suspended for one day in 2003 when Parrish found a container of tobacco spit on Hinson's desk, according to records. Tobacco use is prohibited in the jail.

Dickey's most recent evaluation was done in December. In 25 years with the sheriff's office, the corporal's performance reviews consistently describe him as an outstanding supervisor and officer.

He has come under scrutiny in recent months for efforts as president of the Hillsborough detention deputies' chapter of the West Florida Police Benevolent Association, the union that represents deputies.

An internal investigation was launched based on a complaint that he made disparaging remarks about the sheriff's office as a union member.

Lucas noted the investigation in a comment he wrote in Dickey's most recent evaluation and included this criticism: "His priorities have shifted from the sheriff's office to serving in his capacity of PBA chapter president."

The only disciplinary action in Dickey's file was a letter of reprimand written in 1988 for failing to see that deputies under his charge complied with head-count procedures, according to his records.

Williams' folder lists no disciplinary action.

It does, however, contain a 1995 letter from the Florida Department of Law Enforcement's Division of Criminal Justice Standards and Training Commission. The letter states that Williams violated one or two sections of Florida Statute 943.13, but it does not specify the violation. These sections concern making false statements or perjury, receiving a dishonorable discharge from the military and being of good moral character.

The commission took no action against her but suggested Williams seek training, rehabilitation or counseling and "become the professional officer we believe you are capable of being."

From the comments in her performance reviews, it appears she became a model employee. In a 2000 review, a supervisor wrote that Williams was "one of the unit's best deputies."

I said it before and I'll say it again...the guy can't move from the neck down. He has VERY limited movement in his arms. Not enough to hurt anyone. She threw him around like a rag doll. I don't care what he was saying if in fact, he was running his mouth at all. She could have told him to be quiet and if that didn't work, she could have gagged him. Period. There was no need for quad dumping. She HAS to lose her right to ever work in law enforcement again or ever have a job where she is in charge of another human being's welfare. She should be ashamed and she should move away and change her name.

Under normal criminal circumstances, I would fully agree with DanPalmer. I have no tolerance for crime or low-life criminals but this guy is completely defenseless. There's nothing lower than beating on a handicapped person that can't fight back. So, DanPalmer, as far as gangsters, drug-dealers, rapists, etc...you are correct but not in this case.

If it were this cop's mamma who was thrown out of a wheelchair, do think she'd sit idly by while the offender said "Oh sure.....I did nothing wrong. I'll be EXONERATED"? Bull-Loney! She'd throw those precious little arms up in the air, and scream "Police brutality" and call for the arrest and prosecution of the cop. This "officer's" actions deserves a prison sentence. No slap on the wrist, no probation, no community service. PRISON. PRISON. PRISON. Having done this so matter-of-factly, one can only imagine what else she's pulled that WASN'T caught on camera!

wow i used to work at that jail. this guy come in one time with no arms and one leg, yet still trying to fight the deputies. who is to say that this guy wasn't trying something with this deptuy? all you see is her dumping him on the ground. there is no sound what so ever and it skips around in the video. so go on and believe what the media wants you to believe. most of the time they leave out parts of the story. bottom line is if you don't like how your treated in jail don't break the law and land your butt in jail. and remember this ... there is always 3 sides to every story. the inmates the deputy's and the truth.

I guess not having the ability to walk is considered giving the police "a hard time". I wonder if that applies to not following direction, because one is deaf.

chickntpa. Do you really believe the things you say like for real? Probably one of the worse things a person can do is to mistreat some one they have the power over them that will alow them to do it. Child abuse is one thing. Rape is another power thing. Dumping a person without the use of their leggs out of a wheel chair on the hard floor is another. So many more ways to abuse the power one may have over another. These guards have a power trip going on and need supervision to keep it under control and it appears the supervision was right there watching. This woman needs jail time for what she has done to this person in her charge at the time. Supervisors? Thes men have no place in the system where they are expected to supervise. Watching this video makes me sick in my stomach and makes me have some very bad thoughts about the way I would like to punish this woman.

First I used to be in law enforcement and got out - you have two types of people in it - the very few that are good and others that were picked on in school and wanna be able to be big now and have some control and they abuse their powers. Not enough pay to put a good officers life on the line - result bad officers. Second not everyone arrested is guilty of charges - yes some have been found guilty in court and are then arrested but the majority of people arrested have not been convicted when they go to jail!!! Third - since the majority of mental health facilities were closed our jails are now housing them - whether it is a mental or physical condition people need to be treated the way one wants themselves to be treated.

The SAO will move forward. Right now the HCSO is seeing what can be done to minimize the damage. When they have a plan, they will notify the SAO of the investigation, and the SAO will move.

HSCO has a limited time to act on this. If they drag their feet, the FDLE will take over this. The AG will only wait so long.

Oh yes, our internal affairs people here at HCSO have conducted and extensive investigation and has concluded that that the deputy did nothing unbecoming of law a enforcement agent under the color of law.

Oh great FDLE is going to investigate they are just as bad an agency investigating themselves. FDLE will conclude the same thing HCSO has reported. I think the FBI Civil Rights Division should look into this.

HOW IS THIS IN ANY WAY, SHAPE, or FORM, Sheriff Gee's fault???? The deputy that did it is the only one to blame. Quit looking for reasons to hate every cop! If you cry babies think you can do a better job in the jail, they are always hiring!!!!! All cops hate when people wearing the uniform give us a black eye! Am I the only person who noticed that all of the police officers involved in this incident are BLACK and that poor handicapped guy is WHITE? If the cops were white and the handicapped guy was black, this would be turned into a racial issue and Jesse Jackson and Al Sharpton would be staging a rally to protest this racist treatment of a prisoner. Where are these great civil rights leaders now?

If this incidents motivation was race we will never know. Only the good deputy knows, and the good deputy isn't going to say. It is certain though, that the good deputy has absolutely no regard, and perhaps no knowlege of the Bill of Rights, or the concept of basic human decency.

This is Florida it doesn't surprise me at all... One, the cop was stupid to have it in front of a camera and Two let the tape get out... But it's no different then what goes on all the time, so why is everyone in an uproar over it?

Besides the arrest of these 4 correction officers lets get the video tape for the past year secured by the US Attorney General. I bet we see alot more mistreatment and unacceptable behavior has been going on for some time now. As for those annual reviews, please give me a break they mark "A" in the box so they get a merit raise, regardless if they are good performers or not. It is a standard of keeping the "thin blue line" of law enforcement behind closed doors and having double standards and shielding one another.

deez - I can't imagine the "variety" of nonsense that these jailors have experienced. After a while, tho, your way of thinking changes. When ALMOST every person you deal with is a scammer, you see EVERYBODY as a scammer. That's when an officer becomes a threat to the community they set out to serve. The shame is, this smears ALL cops. The Blue Line needs to police its own, even more than they police the populace. Otherwise, what you see in these posts happens. Enough people have been done wrong, with rage and resentment built up, and every officer suffers. Gee was RESPONSBILE for not properly supervising these officers. Aberrant? I'd believe it - except for all the other testimonials.

I am appalled at the casual way in which Mr Sterner was just dumped from his wheelchair. It makes me wonder if deputy Marshall-Jones has done similar things before. Her body language tells me more likely than not, she has. She should be thoroughly investigated and prosecuted if warranted. The reason the tape took so long to come out is, Sterner called Mike Deason at Channel 10 and told him what happened. Deason asked for a copy of the tape through the freedom of information act. It took a few days to get it. Deason broke the story and that's when the chicken hit the fan.

thanks for the update on Mike Deason. Now as concerned citizens for future violations of an individual, the tapes should be viewed by outside sources throughout the recording time and if lapses occur...immediate intervention..the next problem could be someones' murder we witness..

Didn't read it today, but there were a few yesterday saying how Jones had never done anything like this in the past. What do you always hear about the person that just murdered someone? "Gee, I never would have guessed. He/she was the nicest person I have ever known". There is always a first time, and just becuase there wasn't a prior history, that still does not make it right. I know a cop that worked in the jail at Orient Road and retired. He could not take the daily drama and mental games that his coworkers constantly played out on a daily basis. I am also related to a sheriff's deputy in a nearby county. I wouldn't know where to begin to tell you the stories of police brutality he has openly spoke about during family gatherings.

By the way, because of the stories I have been told by my two law enforcement friends/relatives, I did NOT speak more than I had to when pulled over for the two traffic tickets I received. Some cops are just looking for a reason to start trouble.
