TAMPA - TAMPA - City attorneys seeking a new trial were struck down, again, in a case of a man who was awarded $18 million after a crash involving a water department truck.
The court ruled against the city's motion for a new trial on Monday.
A jury ruled in Ramiro Companiono's favor in the civil suit in 2004.
The city filed its first appeal seeking a new trial because two of the six jurors who heard the case were convicted felons.
The appeals court denied the motion then stating that city attorneys did not prove the jurors were biased and they had ample time to check out criminal records during the selection process.
In 1996, Companioni was on a motorcycle when water department trucks pulled in front of him. The impact left him unable to bend at the waist.
