Walter Larry Bivens was driving his 1993 Buick sedan late last night without his headlights on, police say. When approaching Bivens, stopped near 32nd St. N and 29th Ave. the officer noticed a strong smell wafting out of the Buick.
The officer "was overcome with an odor of marijuana," according to an affidavit, which gives the police version of what happened next.
As the officer got closer, Bivens got out of his car with a two-tone green plastic bag and "briskly began to walk away."
The officer grabbed Bivens, who was then arrested for resisting arrest.
Inside the green bag, police found 458.5 grams of marijuana. Police found a baggy containing marijuana in Biven's right front pocket and another baggy containing marijuana under a towel on the driver's seat.
Combined, the baggies contained 10 grams of the drug.
In addition to resisting arrest, a misdemeanor, Bivens was charged with possession of marijuana with intent to distribute and possession of marijuana, both felonies and possession of drug paraphernalia, a misdemeanor.
Bivens, of 306 Parker Ave. E, was released at 5:59 a.m. on $5,000 bail
