SPRING HILL - Deputies arrested the driver of the Hokey Pokey ice cream truck Thursday on a possession of marijuana charge.
A deputy investigating a suspicious vehicle in the parking lot of 5226 Applegate Road came across Gregory Westberry sitting in the rear of the truck. Deputy Anthony Mazza described Westberry in a report as having "extremely slurred speech" and dilated pupils.
Asked for an explanation, Westberry said he was waiting until 5:30 p.m. to pick up his kids from day care. By his watch, he had only been there 10 minutes.
While Westberry was accurate on the time — it was approaching 5:30 when Mazza began his questioning — the citizen who called in said the truck had been sitting in the parking lot for three hours.
Westberry told Mazza he had drunk five to six beers after completing his route, but the deputy didn't notice any smell of alcohol on Westberry. When Mazza pointed this out, Westberry confessed to smoking marijuana and emptied his pockets of a bag holding .8 grams of marijuana and a smoking pipe onto the hood of the cruiser, a report states.
Westberry, 34, was given two misdemeanor citations for possession of marijuana and paraphernalia.
