TAMPA - Just before midnight Wednesday, a deputy noticed three children sitting in the bed of a red truck traveling west on Hamilton Avenue near Church Avenue, according to a Hillsborough County Sheriff's Office arrest affidavit.
The children were sitting on top of the tool box as the truck was moving, the affidavit states. When the deputy stopped the truck for a traffic violation, he noticed that the driver, Alberto LaGuardia, was drunk, the affidavit states.
LaGuardia, 55, agreed to sobriety tests and failed the exercises, deputies said. His blood alcohol level was 0.119. Florida law presumes a driver is impaired at 0.08.
He told deputies he was on the way to store to buy soda for his children, the report said.
He was charged with DUI, driving with a suspended or revoked license and child abuse, jail records show. LaGuardia is being held tonight in Orient Road Jail on $4,500 bail.
