MANATEE COUNTY - Prosecutors are moving ahead with a case against one of two 93-year-old men picked up during undercover prostitution stings.
In the case of Frank Milio, prosecutors have issued subpoenas and plan to take him to trial in April.
Milio, according to police records, tried to pay $20 in November to an undercover officer on 14th Street West.
Milio recently told the Herald-Tribune he was only flirting with the woman.
"I haven't had that in years," he said. "Ninety-three is kind of old."
Carlos Underhill, 93, will not be charged, although he does not deny stopping to chat with the "good-looking girl" who made eyes at him and turned out to be an undercover officer.
Police say Underhill was willing to pay $30 for sex and that he promised to come back a few hours later to consummate the deal.
Prosecutors say that they cannot move ahead with the criminal case because there is no way to prove Underhill planned to come back.
Underhill was fined $150 for trying to pick up a prostitute in 1990, when he was 75. In the latest case, he says, he was not cruising Tamiami Trail for sex: He just wanted to chat with the buxom woman who smiled at him as he drove past.
"All I was going to do was talk," he said Monday. "It wasn't for sex. I am 93, you know."

It is definitely funny but everyone blames the cops. They are only doing their job. What needs to change is the law. You will never stop prostitution or drugs. Both should be legal for adults and and removed from the streets to a red light district in an industrial area. Tax it and reduce my property taxes.

I believe the old man. He's 93 yo. Sex at that age will prob kill him. He's made it this far, I'm sure he wants to make it to 100. Prob just wanted to chat with the lady. People need to stop putting Grandpa and Grandma on the back-burners and give them the love and attention they deserve. Then maybe they wouldn't be so inclined to talk to strangers...and pay for it.

Give me a freakin' break. Speaking as a retired police officer, I have to say that the Manatee sheriff's office and prosecutors must have too much time on their hands if they intend to pursue this case. If, after concluding their intensive investigation, they didn't find Viagra on the old guy he was probably just looking for some fairly innocent attention. Leave the old guy alone and start a task force to nail the screwed-up drivers running so rampant in this area. Am I the only one around here the hasn't lost the ability to spot the obvious? Once again, more evidence of Obama voters.

I think its absolutely fantastic that this man is of sound enough mind and body at 93 to enjoy the company of a woman. I should be so lucky when I get there. Prostitution is a paid encounter between consenting adults which effects nobody but the participants and should be legal. Don't the cops in Tampa and the surrounding metropolitan area have an unsolved murder or twelve to worry about?
As for Smackie and freespiritman, the story was linked to on the DrudgeReport, and the readership is likely worldwide. Get over your self-importance. While Tampa may not actually be in Manatee county, most out-of-towners would probably assume it is since this website proclaims Tampa Bay online, and The Tampa Tribune at the top, and you're close enough to Tampa to be considered part of Tampa by the rest of the world.

I don't get why cops are being paid to entrap people. Unlike some other posters, I don't think it's charming that the old man is looking for prostitutes - but it's way less charming that tax $$ is going to cops to dress up and play games with people, entice them to commit crimes and then arrest them. Cops are already bad enough. It's wrong to pay them to be more corrupt and lazy than they already are.

When picking up a prostitute, negotiate a price upfront and then promise to come back a few hours later to consummate the deal. They can't charge you because they can't prove you actually planned to come back.

The perception that older men are not sexually active is not true, at least in my family. My wifes great grandparents were very sexually active into their 90's as her mother could hear them from her bedroom down the hall. There should be a case for entrapment in these cases, if politicians are getting away with their misdeeds with that argument it seems a case couild be made here. Imagine flirting with a man in his 90's. Either the cops were pretty obvious to anyone with good eyesight or they were pretty desperate for a case. Either way, preying on uh, almost innocent older men is at least as bad as preying on elderly women. Is this the best that these police officers can do? How about cutting the budget, starting with them.

Hey, I hope the IDIOT Manatee County DA goes after this old guy, gives it his/her best shot in a jury trial, and the old guy gets a public defender (all at taxpayer expense ..... Manatee county deserves this if the public tolerates stupidity like this in their police force), and fights it out till the end. But here's the good part .... if the commentors to this article represent a jury pool, first off, he's gonna get off, and secondly, there's gonna be publicity and probably a lot of it! And in response to the publicity, I wouldn't be a bit surprised of several of the Tampa area ladies offer up a freebie (or two) to the old guy (and maybe even his pal who wasn't charged) as a goodwill gesture. They violate the 1st Amendment by opening mail, caging demonstrators and banning books like "America Deceived" from Amazon.
They violate the 2nd Amendment by confiscating guns during Katrina.
They violate the 4th Amendment by conducting warrant-less wiretaps.
They violate the 5th and 6th Amendment by suspending habeas corpus.

It's the corrupt system that needs to be pulled out by the root. That the cops were doing their "job" should make this obvious. Law enforcement is where thugs are hired to force people to act as their rulers dictate that all people must act. Private security is where people are hired to protect persons and property from harm. Totally different incentives result in totally different results. The statist-system emphasizes obedience to rules and rulers and treats everybody like a child in need of supervision; the free-market-system emphasizes justice and treats everyone according to their perceived threat to the persons and property being defended. So do you want to live in a police-state (status quo) or do you prefer liberty and justice (free-markets)? Think about it if you can.

I feel so bad for this guy. First of all, prostitution should be legal. But if you aren't going to legalize it, you should allow certain types of people to use it. Elderly, people who lost a spouse etc. Who are we to deny such a basic human right as sex? Absolutely pathetic. There is honestly no other way that a 93 year old man could obtain sex. His wife is probably dead and even if she weren't I doubt she would be interested. Same with any other 93 year old single women. Another example of someone using their age to get out of being prosecuted for criminal activity. Funny, I have searched and momorized most statutes and most have nothing to do with age. A 73 year old can be just as dangerous as a 20 year old in many ways. This is reverse discrimination is a big way. Denny here.

You want to hear about entrapment, I was reading this story the other day about topless sunbathers in a PUBLIC park. So the women would take their clothes off, lay in the grass, wait for some guy to strike up a conversation. After flirting with him for a couple minutes she would put her foot on his shoulder and ask if he wanted sex for $. "BUSTED! You were trolling the park looking for prostitutes!" As a regular visitor to your area I wonder if the real problem isn't economic inequality, lack of computer literacy among the elderly and/or illiteracy. As you surely know - many local freebie publications publish ads where a willing companion will be delivered to your door and if you are unable to find one then the computer world is full of lovely young sorts doing direct marketing in this sought after specialty - failing that open the yellow pages and look under escorts - the problem isn't prostitution but simply how you acquire your prostitute - personally I think these guys deserve an award for being able enough to get to a woman - as for the police - good to know there is no crime in Manatee county other than that created by those with badges - what is the difference between crime and cops? One has the authority of the state behind them - neither are to be trusted - much like a wayward spouse you cannot trust them in the same room if your back is turned - is it too much to ask where the community is in this? Is this really doing any benefit to you other than generating fines and court cost?

Spitzer was paid an ridiculous salary through taxes confiscated from the good citizens of NJ. He spent $80,000 of that tax money on high end hookers. Wasting tax money on booty is what was wrong in his case, not to mention cheating on his wife and shaming his family.
Paying another adult money directly for sex instead of bartering dinner, flowers, and a show for sex or a few rounds at the club may be morally wrong but so are a lot of things we do that are legal and don't harm others.
