CLEARWATER – A judge sentenced Nick Bollea to five years probation and eight months in county jail after the 17-year-old pleaded no contest this afternoon to reckless driving.
His attorneys had asked Circuit Judge Philip J. Federico to spare the 17-year-old a state prison sentence.
"Something has to be done to show this is not acceptable," the judge said, in imposing the jail sentence.
The judge also ordered Bollea to serve 500 hours of community service, "working in some positive framework," but not speaking engagements. Federico also revoked his driver's license for three years.
He is not allowed to drink alcohol during his probation, and also to undergo an alcohol evaluation and treatment. He also must attend DUI and advanced driving school within a year.
Federico withheld adjudication of guilt after hearing pleas from the defendant and his family not to label him a felon. The family of his victim urged a finding of guilt.
He could have faced a sentence ranging from probation to five years in prison, but the judge agreed to cap the sentence at a year in jail, followed by up to five years probation, as part of the plea negotiations in court.
Bollea, the 17-year-old son of former wrestler Hulk Hogan, entered a not-guilty plea after being charged in November in the Aug. 26 crash that critically injured his passenger, John Graziano, now 23.
Bollea apologized for the accident, saying he prayed for Graziano every day. "I love John to death," he said. "He is like my older brother and my best friend."
He said he's changed since the crash, and has raised $60,000 for a charity dedicated to research into brain trauma and to easing Graziano's medical costs. He said he's also tried to bring attention to safe driving and the importance of wearing seatbelts.
Dressed all in black, including a scarf on his head, Hogan, whose real name is Terry Bollea, urged the judge not to make his son a convicted felon. His plea: Withhold adjudication.
"My son has really, deeply been affected by what occurred in this accident," Hogan said. "What I don't want to see happen is another tragedy. Nick is going to have to live with this experience the rest of his life."
He said the public misunderstands his son because his personality is not what was portrayed on the family's reality television show, which Hogan said was scripted. Hogan said his son would be sitting at his computer and show producers would ask him to throw water balloons. "Nick is a good person," Hogan said. "He's kind. He's gentle. He's compassionate."
Graziano's father pressed for jail time, saying, "This has gone on long enough and needs to be stopped."
Citing his son's service in the Marine Corps, Edward Graziano said, "What al-Qaida could not do to my son, Nick Bollea did in a matter of minutes. He destroyed my son's future. …This court must put a stop to Nick's repeated disregard to speeding laws."
Graziano's family members are asking for an adjudication of guilt and six months to a year in jail, Assistant State Attorney Scott Rosenwasser said. "We would go along with what their wish is in this case," the prosecutor said.
Rosenwasser noted that the defendant's father wrote the court, saying the crash was an accident. The prosecutor said he wanted Bollea to understand that was not the case. The prosecutor said Bollea made the choice to drive the way he did on a wet road. "I want him to understand that it's his fault. This crash was his fault and only his fault."
The prosecutor joined family members urging the judge to adjudicate Bollea guilty. He also asked for 500 hours of community service work and drug and alcohol evaluation and treatment.
Graziano family members said Bollea has not shown remorse or apologized for the crash. They said Bollea rode a skateboard and shot darts in the hospital while visiting their son there. They also cited Bollea's numerous past speeding citations, saying he failed to learn a lesson.
Bollea's defense attorney, Kevin Hayslett, asked the judge to withhold adjudication of guilt and revoke his driver's license for a year. During the hearing, Hulk Hogan sat behind his son in the courtroom, bowing his head against hands that were pressed together as though in prayer.
Graziano's guardian filed a lawsuit in March against Hulk Hogan and his family for injuries that left the Iraq war veteran in a semiconscious state.
Guardian Peter Musante is suing the famed former wrestler, whose real name is Terry Bollea, as well as Bollea's estranged wife, Linda, who has filed for divorce. The suit also names Nick Bollea as a defendant.
Millions of dollars are needed to take care of Graziano, who resides at James A. Haley VA Medical Center in Tampa, said George Tragos, the attorney representing Graziano in the civil lawsuit.
TheGraziano family is in court to give the presiding judge their opinions.
If Bollea is adjudicated guilty, it could strengthen the civil suit, Tragos said.
The teen was driving a Toyota Supra when it smacked into a tree. The driver whom police say Bollea was racing, Danny Jacobs, 22, also is being sued.
Part of Graziano's frontal lobe had to be removed, but he responds to heat and touch, and there is eye movement. On occasion, he has breathed without a ventilator.
Before the wreck, Bollea — at the wheel of the Supra — and Jacobs — at the wheel of a Dodge Viper — were racing through downtown Clearwater, police say. The Supra, which came from the factory with 300 to 330 horsepower, had been modified to more than 400 horsepower, the suit states.
Jacobs pleaded no contest in February to a charge of reckless driving and was sentenced to probation.

This what it costs a family when they don't take their responsiblity seriously of raising a child. Our state needs to look into way we give out driver's license to our younger and inexperience drivers so tragedy's like this are taken out of the parents careless hands.

Can anyone explain why this is news - please, Because I just don't get this family and their major dysfunctional issues. He could've killed the other person, almost did, and they give him coverage like he was some sort of hero or something. He is a common criminal with horrible role models - he most likely never had a chance but to be a racing who cares kind of wanna be thug.
Trees have to die to print this stuff TBO - electric is being used up for these idiots..Judicial time is being wasted on him, just lock him up for a couple of years. Maybe he will learn his lesson and maybe he will come out a better person for it..
Give me a break - I know I know, I sound like a hater, but please..does anyone really care that he pled down after that horrific accident...did we really expect him to be treated and act any other way?

TampaGirl4Ever, yes there are many people who have been following this story since the beginning and are interested in the final outcome. If you are not interested than don't read the item but don't tell the rest of us not to read it. And if you don't already know, here in the US we have a concept called due process. We don't just willy nilly lock people up without a trial or plea bargain. If we followed your reasoning we would be locking people up just on suspicion of a crime. Kind of sounds like Nazi Germany.

Let's see my kid just got his driver's license so I think we should buy him a fast sports car. He will look so cool and represent the fact we have money. Then if anything happens we'll just buy his way out of trouble to teach the law a lesson for messing with our little rich kid. After all without that car maybe he would look just like every other kid in school.

I just have a stupid question here--since Nick had gotten previous speeding tickets, why in the heck did his parents not take his driving privileges away? I have a 17 year old son who just started driving. His insurance is killing me....I couldn't imagine what it would cost me if he had a couple of tickets. If he did, he'd sure as heck be walking.

I hope for this young man's sake he has learned some of the important lessons of life. The responsibility one has to take for their actions and the ramifications, good or bad of the actions taken. It's what separates the men from the boys. It is a very hard lesson and many, even in their older years, have not yet been able to stand up and say "I was wrong".

Hopefully the judge will give him state prison time and make the charge a felony. Guy like this who have super rich parents think they are above the law. What he did deserves harsh punishment along the lines of losing his driver's license and serving 4-5 years in prison. This was not his first speeding ticket. As a licensed driver on public streets - she should have exercised greater intelligence when deciding to race down a city street. This is no ordinary speeding case. He caused severe and permanent injuries to another person. This is in intolerable.

I don't think he deserves to go to jail. 5-10 year D.L. revocation and probation would be sufficient. If Graziano were able to say so, he probably wouldn't want Nick to go to jail. The shoe could have very easily have been on the other foot. If I remember correctly he wasn't wearing a seatbelt..he should have been responsible enough to wear one. I'm not justifying what happened. I just think as a friend, that's how he would feel. I know I would.

Would we be talking about this if John Graziano was wearing his seatbelt? I appreciate the fact that this Marine served our country so faithfully, but it was also John's responsibility to fasten his seatbelt when in the car with Nick. I am really displeased at the fact that John's family and friends are exploiting the fact that he was a Marine, trying to sway the judge's decision on sentencing.
Do I think that Nick deserves some sort of punishment? Of course I do. Do I think that Nick was wrong? Sure. Would I be writing this if a Marine that wasn’t wearing his seatbelt was not in the car with Nick? Absolutely not. Who’s this Ashley Berry girl? She quotes Marine code of honor trying to once again sway the judge’s decision. I am so tired of people exploiting our men and women in the Armed Forces. I certainly feel horrible for the family and friends of John Graziano, but I don’t think that Nick deserves all the blame. I think this is a perfect example of why it’s so important to wear your seatbelt.

Just a thought..I find it odd that at first the family was all about how good of friends the Bollea's were and how much support they were given. Now they want this kid nailed to the wall and all their money. Do you really think for a second that they went out and obtained legal representation? Doubt it.
And yeah, people complaining about their celebrity....You're apparantly paying attention to them, and it's just making them more notorious, the Bollea's thank you for it.

Some of you people really need to get a grip on reality. You don't just throw a 17 yr old kid in jail, regardless of who it is or how spiteful you want to be. Think about how many stupid things you did as kid now, think about this: this kid has unlimited resources and lives in the limelight because of his father's success. Anyone at that age would make stupid decisions. Sure there should be great consequences for his actions but, his parents didn't "buy his freedom" either. He didn't walk, he's pleading no contest and will take whatever punishment is given. The kid made a mistake and a very costly one at that. And don't get me wrong, the family of the injured should be compensated for their loss and not worry about John's medical bills but, locking nick away isn't going to do anyone any good.

LoL he's had no more traffic violations than the majority of kids his age if not less, I mean, it's public record! My view of this case that i've been following...the fact that this kid is of a celebrity family and that he never showed remorse or apology for his 'best friend' leads me to believe that Hulk Hogan's family is asking for a reduced sentence for a kid that does not deserve to get off scott-free.....if it happened to an ordinary person....they would be given the maximum sentence.....Now during the trial, Nick is expressing remorse and apologies...expressing John was his 'best friend'....
I believe that Nick should be made an example for his irresponsibilites of this incident. Giving 6 months to a year in a county jail with 5 year probation is NOT enough....
I believe he should serve his sentence in a state prison with hard labor.....whether it is 6 months, 1 year or the maximum of 5 years.....
these rich kids believe they are above the law and can get away with anything...just because their parents are famous...I do not believe that Nick has grown up since the incident...I believe it is all a dramatic act....
money is the key here...it can pay for the best defense...as a poor person would be sentenced the maximum for the same crime.
Maybe if Nick went to state prison and did his hard labor per se cleaning up the roadside ex. at Lake Ocheechobee (not in Tampa Bay area where his friends can drive by and 'visit him')...cutting down weeds or picking up garbage.....during the day, and back inside the prison at night, and NOT in isolated confinement...maybe THEN this kid would learn responsibility.
Don't feel sorry for him, I feel sorry for John.

I still have a hard time with this whole situation. Nick does indeed need to learn from this and as (petagirl) stated, give talks at schools and educate to really see how this mistake has affected everyone and to make changes in his life and hopefully others. Both families have suffered. I just keep going back to the fact that Graziano got into the car with Nick knowing how he drove (this was not the first time Graziano drove with him), not wearing a seat belt and as an adult. I won't start my car until all seat belts are on but I am also 33 years old not 17. I also would not ever drive with anyone without a seatbelt on. We give our kids the responsibility of driving at 16 years old and expect them to follow the laws. They are kids and they are going to make mistakes. I think too many folks are judging Nick for actions that he is too young to know the ramifications for because he has a high profile family.

Out of 10 people you know directly, supposing that 10 people want to associate with you, have received more than 2 moving violations, and out of that how many have you got in a car with? ....Now i'm going to predict your response, your going to whine about something and then claim it's not relevant about who you know and what their driving records are because none of them nearly killed anyone.

mexibug, like it or not, seat belt usage is NOT a choice, it's the LAW. And Bollea is responsible for the passengers in his vehicle buckling up. If you don't want to obey the laws, STAY OUT OF A CAR. You are a danger to the rest of us if you don't wear a seat belt.
Additionally, I see his genius of a father even wore a diaper on his head in COURT. This kid has no future with a moron father like that.

Im sorry call me bitter but he deserves the worst, not only was he extremely speeding he was endangering other innocent people and on top of that he was drinking. 17 or not he knows right from wrong, how would yall feel if it was ur mother he hit and not a tree????

WHOA- Concerned1963- I agree with you 100% I always wear my seatbelt and it is the law. You are correct. However, in reality- it is a choice that he made NOT to wear it is all I was saying. I won't drive the car unless all in my car have their seatbelts buckled.

It means he isnt taking responsibility, this screws the other family because its a big part of the civil lawsuit - its all about money now

They got what they wanted and then some, how is the judge a joke, they often hand down sentences per the recommendation of the DA, if the DA recommended no jail time then he wouldn't have got any. You should bash their boss which would be, if I am correct, Mark Ober. I think they did a fine job though, a deserved punishment which could have been worse and honored the wishes of the Graziano's. Nick will get out in 3 months.

Yes Nick doesn't seem to understand the gravity of his actions. And of course his PARENTS should have guided him and tought him to be a more responsible and socially aware person. BUT - we can't change the past, and I do feel for his father (millions or not) who is now left facing the REALITY of his son's mediocre version of a grown man. You can't change the past, let's not ride Terry Bollea into the ground for what he neglected to do in the past. It's now up to NICK to figure it all out and learn from his actions. He's old enough to handle life!

To the "15 years" comment -- the maximum sentence Nick could have received was 10 years. So that "someone" you know may have had a different history, as well as circumstances which made it a lot more likely to get a 15 year sentence. So, boo-hoo to the "black people" whiny-whine comment.

This is a sad situation all around. But if you listen to the judge's reasoning regarding his sentencing, he was very fair, he is making Nick suffer consequences by going to jail,probation, etc. But Nick is still a juvenile with no criminal history, traffic stops are not criminal. Everyone made some very poor decisions that night, including John. As close as John was to Nick's family I don't feel he would have wanted Nick's life to be ruined over this. He could just as easily been the driver and the story would be the same but each player in different parts. I think the parents here are the ones who should be held accountable. Nick should have lost all driving priviledges a long time ago. They not only didn't do that, they provided him with a "death machine" vehicle.

The law requires all front seat occupants to be restrained. It's not a choice anymore. What a joke--8 months. Small price to pay for ruining someone's life. Does anybody really think this will make a difference in that spoiled brat's behavior? In 8 months, he'll be back on the road trying to kill someone else, because, after all, he's so special, while the other poor guy will be destroyed for the rest of his life. WAKE UP AMERICA! Gina1108: Adjucation of guilt means that if he serves his whole sentence and restitition, he will not be a convicted felon. Very serious for someone so young.
Also remember that Nick did step forward to accept his punishment instead of putting our tax money through a long, drawn out trial (because lawyers want their pay) That does say something in his favor. And, as the judge remarked, quickly, just as soon as the legal process was at the point he could do so. Things do not move quickly through our court system.

Lets see, he pleaded no contest rather than guilty so he has not admitted to any guilt for his actions. The judge sentenced him to an 8 month sentence in a local jail (Where the cops who let him off the hook the last few times he was caught speeding work) rather than a prison, and 5 years of probation and 500 hours of community service (based on a 40 hour week thats 12-1/2 weeks) and he can't drive for 3 years (or get caught drinking for 5 years.) The judge did not find him guilty (witheld adjdication of guilt) and he will not have a record as a felon. All you lawyers out there please correct me if I'm wrong but this means he got a very light sentence and was not found guilty of anything. When they go to a civil trial the court will have to take into account the fact that he was NOT FOUND GUILTY OF ANY WRONG DOING.
Does anyone think this is fair?

Not to put blame on Graziano but what 23 year old hangs out with 16 year old? unless your a female teacher of course. Thing is the reason he hung out with him is because Nick was one of the "it" kids, had the fast expensive car, the reality show. So when you put yourself in harms way of a spoiled 16 year old with a fast car and not wearing your seat belt, no its not your fault but you might could have taken a few precautions to not be in this result now.

Please watch the video of the court session. I was watching it live and I wanted to slap Nick's lawyer through the computer. All through the judge's dissertation he was bobbing his head and smiling. He's the blond on Nick's left. I wouldn't expect him to be so happy losing all of those billable hours for a trial.

I WAS IN THE COURTROOM TODAY...one of the few people there who were not friends nor media...so here's my unbiased observations...
odd things not reported that i noticed:
1. graziano's lawyer, representing the familia, started the trial off by seeking only 6 months to one year of jail-time...not a big deal...but it gave the judge a good starting point to reduce all aspects of the sentence (i think it carried poss max jail-time of 2-5 years)...especially, if the graziano's were so concerned about the adjudication of guilt issue(rightfully so)...
*it should be noted that graziano's lawyer made it clear that the family only seeked a 6-month jail sentence...until the morning of the trial the father told the lawyer he wanted to push for one year*...
2. once it was determined that sentencing would be done today, john graziano's family spoke...dad, mom, sister, girlfriend...they spoke at length about how great of man john is...his outstanding marine & U.S. service...his life currently...they spoke of nick's horrible past with speeding tickets & warnings (it was ridiculous how many - 5 or 6 in less than a year...some over 100 mph...including hulk in car)...they seemed to try to make a point that john was not a daily ritual in the hogan household...at the time i didn't consider this an issue...but very effective speeches/tributes...
3. The Hogans spoke next...it became apparent that the hogan's emphasis is graziano was a member of the family...always there...the hulkster first...he spoke in a somber voice for 10 minutes...he seemed very remorseful and BY FAR the most appropriate speech by the hogans...the wife/ex-wife spoke next...after one minute of reading she started to cry...somewhat...but whatever tears were coming out were for her son...not for john graziano...one of nick bolles' lawyers then read a letter from nick's grandfather...the grandfather stated he was a california police officer for 25 years...he stated something along the lines of nick not being responsible for the accident...at which time, the lawyer stopped reading and told the court that he did not agree with the grandfather on that point...
4. (This gets its own number because of its irrelevance)...The defense then presented a CEO of some charity organization and he told this story: nick called him on the phone 3-4 months ago and wanted to get doing charity work...the charity that nick is "working on" is for "John & John"...not sure who the other "John" is but it was explained that he was a victim of an unrelated accident...it was stated for court record that to date, nick & the organization has raised over $60,000...for the two johns and brain research...oh yeah, hulk hogan has been a spokesman for the CEO's charities for years...CEO testified that he offered nick $150 a day but nick won't take it...
*the logical connection seems that nick uses his 500 community service hours...towards a charity...to pay off some of the impending civil suit...

Then Brooke spoke...she emphasized that john was her & nick's best friend and part of everyday family-life...she questioned why so many graziano's were at the trial when they weren't there for him the last few years...then she blamed the media for hassling her and her family...shortly after she stated between sobs, "That's why I hate being a celebrity."...then nick spoke...his speech was very good and on three occasions turned to face & apologize the graziano family...however, for the previous hour, we listened to graziano's saying that he has NEVER apologized...but today it seemed very remorseful & effective...
*as a spectator, it was difficult to keep reminding myself, that nick & brooke are just kids...they carry themselves VERY well and mature...their home-life seems poor...
6. On a separate note, early in the hearing, the prosecution showed (i think) a computer-animated re-enactment of the racing/crash...and also a video of john's day-to-day life...because they didn't show the courtroom, we could only observe the judge...he seemed uncomfortable at times...fidgeting, wringing his hands and looking away periodically...nick stood in front of the courtroom and viewed the 15-minute video...
7. Bubba the love sponge's lawyer-extraordinaire, kevin hayslett, sounded smooth and in-control of nick's defense...i would guess it was his litigating and manuevering early on to negotiate the parameters of the plea bargain that lead to hogan's ultimate victory...he had an assistant lawyer who read the grandfather's letter...he was not near as smooth..
8. Graziano's lawyer seemed happy just to be there and didn't seem contentious on any point the defense made...why?
9. It was noted that the city of st pete had accident investigation costs of roughly $6,200...
10. Hulk wore black bandana...very classy for your son's biggest day...just show the dome...you're a world-class legend...brook wore a beautiful black dress...unfortunately, it was backless and probably a left-over from a red-carpet event...not sure if the judge heard much of her testimony though...she looked great...brook and mom had matching trendy glasses though...
11. Hulkster held the book, The Power of Now...he showed brook at least one passage during the proceedings...
OVERALL:
It seemed like a horrible situation...john graziano's good life is done...many loved ones hurt...because of drinking and driving fast...it could happen any night between any friends/family...
It is apparent, the graziano's are not looking for a pay-day...they are definitely the victims...they did not request the maximum for nick's penalty...in fact, it seemed on the low-end...they are stuck with a NO-WIN situation in sight regardless of what happens to nick...

THERE IS NO DOUBT TO ME WHY NICK PLEADED "NO CONTEST" TODAY...i think he got off real easy (eventhough he is very young)...if this were to go to trial...if the jury hears about a portion of john's brain removed...and sees john's day-to-day life including video...plus, a re-enactment of the crash...his history with speeding tickets and warnings....a jury of common citizens would probably be horrified & appalled...

Yes I never made a mistake of that magnitude when I was a teenager. Why because my mother would have strangled me. The courts and cops would have been the least of my worries. I have a kid and he will have limits also. I am also willing to bet he wont see the inside of a jail just like me. Fact most people in jail deserve it, (Black, White, Hispanic etc)

I am surprised he ended up with jail time. I figured he'd get probation and lose his license for awhile. Part of me starts to feel bad for him going to jail until I think about how many tickets he's received. It was only a matter of time before something like this happened. I do wish him the best though. I hope when all of this is over and put behind him that he goes on to do something good with his life. My prayers are with John and his family too.

If this guy is/was his best friend like he says, why did we not see any tears today in court - he just stood there with his lawyer looking at him like the lawyer was in love with him. That was weird - the way his lawyer looked at him adoringly. And how come everyone else in the world has to take their hats, scarves, do rags off their heads while in a court of law except that idiot Hulk Hogan? That kinda reminds me, wasn't it kinda funny that his father just couldn't help himself and had to bring up the service. was he saying nick should be punshesd more cause his son serverd? like the rest of us who haven't serverd shouldn't be thought of the same way. That was the mother of John Graziano, just a few weeks after it happend. BEFORE the lawers got to her, but now it's like a full on 180, almost like a Democratic Presidential Candidate, (sorry had too). Now she's just after the money or so it seems.

Graziano knew or should have known what he was in for. He was a seasoned Marine, Gulf War Vet. Bollea is a teen. They were best friends and this is a tragedy. I think that the sentence definitely fit the crime. To all you haters..let he who is without sin cast the first stone. Bollea is not the first or the last to experience this life-changing event.
1. I have experienced permanent damage from a foolish driver on the road.
2. Someone in my family suffers because of a foolish mistake he made that cost the life of a friend.
3. A friend lost her daugher to a foolish driver racing and running into a light post.
Bollea is getting punished and everyone's life is changed - like anyone and everyone affected by this type of crime. At least he's taking reponsibility, and trying to understand what happened. Quit with this "he was a Marine" crap!! It is totally irrelevant to the situation.
... and shame on the father and others for repeatedly bringing this up in the press and court statements ...for purely selfish reasons ONLY! THEY WANT 10s OF MILLIONS FROM THE BOLLEAS! The taxpayer will pay for Graziano.
