TAMPA - Local defense lawyer Kevin Napper, accused of propositioning an undercover police officer, has been placed in a pretrial diversion program.
Napper, married to Circuit Judge Katherine Essrig, was put in the misdemeanor program designed for first-time offenders.
"He qualified," Assistant State Attorney Pam Bondi said today.
Tampa police said Napper stopped the gold Mercedes-Benz he was driving at 2 p.m. Sept. 29 in Drew Park and offered the undercover officer $40 to perform a sex act.
If Napper successfully completes the program, Bondi said, the charges will be dropped. The program supervises candidates for up to a year.
