BROOKSVILLE - A Bushnell man serving three years in prison for a DUI manslaughter charge is being sued in connection with a traffic crash that occurred last April.
The plaintiff is James Broman, who was delivering mail in his freight truck when Rickey Scroggins broadsided him at the intersection of U.S. 41 and Powell Road.
The collision tipped over the truck Broman was driving and killed a passenger in Scroggins' pickup. Andrew Cuthbertson, 19, was on leave from the U.S. Army at the time of his death.
Scroggins, 24, received a three-year prison sentence and a lifetime driver's license revocation after pleading no contest to multiple DUI charges on Sept. 12.
In his suit filed Thursday, Broman accuses Scroggins of auto negligence that caused his "permanent and significant" injuries.
The suit also targets Progressive Insurance, Broman's private insurer, for allegedly denying his claim for benefits after a collision with an uninsured/underinsured driver.
Broman also asks for allegedly denied benefits from Lincoln General insurers, the insurance company for his employer, Phoenix Transport Services Inc.
Records show that an auto negligence suit filed by Phoenix Transport Services against Scroggins was dismissed on Oct. 2.
No response has been filed by the defendants' lawyers in Broman's suit.
