TAMPA - A company that was denied a permit to build a landfill near the Green Swamp is appealing the decision to an administrative law judge.
Angelo's Aggregate Materials filed a petition Tuesday with the Florida Department of Environmental Protection asking that a judge decide whether it should be allowed to dump household waste on land it owns in Pasco County.
In denying the permit last month, the DEP cited a high sinkhole risk and a lack of assurances there were adequate plans to deal with sinkholes.
The landfill drew opposition from neighbors and environmentalists who said liquid waste generated by the decomposing garbage would leak into the groundwater and contaminate drinking water supplies from Dade City to Tampa and beyond.
But Angelo's claims it designed a state-of-the-art landfill with a double liner to prevent leaks. It wants the judge to decide whether it provided a reasonable assurance the landfill was environmentally sound.
Those opposed to the landfill have also filed petitions with the state and will be included in the hearing.
No hearing date has been set, and a judge has yet to be assigned.
