TAMPA - A Tampa man has been charged with defrauding a 71-year-old widow out of $19,000, Florida Chief Financial Officer Alex Sink said today.
Moctor "Justin" Ndiaye, 35, of 10307 Riverburn Drive, was arrested Monday night as he left the home of the victim, according to a news release from Sink's office.
Ndiaye pretended to sell the woman a high-yield annuity through Mutual of Omaha starting in December 2008, but deposited her checks into his personal account at another bank, detectives with the Division of Insurance Fraud said.
Ndiaye, who told investigators he is an agent with Settlers Life, is out of jail on bail.
If convicted, he faces up to 15 years in prison and a $10,000 fine.
"The number of complaints from Florida seniors about annuities has nearly quadrupled in the last three years," Sink said in the news release. "Better financial protections for our growing population of senior residents and tougher consequences for those who defraud our seniors demand our immediate attention."
Sink advocates the Safeguard Our Seniors legislation that would make "twisting" an annuity to a senior consumer a third-degree felony and create other protections against fraud.
