TALLAHASSEE - A proposal that would expand the use of DNA collection in Florida is gaining traction in the Florida House.
The bill (HB 1151) that won approval in a House committee Tuesday would require police to take a DNA sample from felony suspects when they are arrested and booked into jail, instead of waiting until they're convicted.
It would initially apply to anyone arrested for murder, assault and battery, sexual battery or lewd offenses.
The American Civil Liberties Union says the measure is unconstitutional since people are innocent until proven guilty and should not be subject to DNA testing before being convicted.
The bill would also be costly to implement, making it tougher to pass in a year where money is scarce.
