TAMPA - Jury selection is under way in the first-degree murder trial of a man accused of plowing his truck through a Fourth of July gathering, killing a toddler and injuring another child.
Prosecutors will seek the death penalty if Derrick McNeal, 40, is convicted as charged in the 2005 case.
Authorities say McNeal was trying to run down his ex-girlfriend, Tosha Montgomery, when he drove his Dodge pickup into a yard on East 24th Avenue. The truck hit a car, a fence, a house and the two children.
Demontaye Simmons, 2, was killed and a 4-year-old was injured.
McNeal was arrested a few days later.
