A judge says billboards and television ads supporting an amendment that would define marriage in the Florida Constitution can stay up for the election.
Opponents of Amendment 2, which voters will decide today, had argued that the ads should be taken down or stopped because they are illegally funded.
Miami judge Mary R. Barzee ruled about 5:30 p.m. Monday that no action should be taken on the eve of the election. She will decide later on the question of whether the ads were improperly funded.
The amendment's supporters, Florida4Marriage.org, have said all the donations they have been given and ads they have run are legal.
Florida already bans same-sex marriage, but voters will decide if they also want to add a definition of marriage to the state's Constitution.
