An inmate who killed a Tampa teenager more than 25 years ago is facing execution Feb. 11.
Gov. Charlie Crist scheduled the execution of Wayne Tompkins for the March 1983 murder of 15-year-old Lisa DeCarr. Tompkins, 51, was originally scheduled to die Oct. 28, but appeals caused delays.
He is scheduled to die at 6 p.m. Feb. 11 at Florida State Prison near Starke.
Attorney General Bill McCollum certified to Crist on Monday that all stays had been lifted and the governor is required to set a new execution date within 10 days.
Martin McClain, Tompkins' attorney, said the scheduling is very upsetting, because Tompkins is innocent.
On Dec. 5, the Florida Supreme Court rejected another request from Tompkins to let his lawyers investigate and present constitutional challenges based on a new sworn statement by a key witness. A former inmate who testified Tompkins admitted to him he was the killer now says a prosecutor told him to give the jury false information. The justices offered no explanation for their decision, but previously called the false testimony a harmless error.
McClain said the revelation should be grounds for a new trial.
Man Accused Of Having Sex With Underage Girl
A 25-year-old Riverview man had sex with an underage girl Sunday, Hillsborough County deputies say.
Deputies arrested James Bogun, of 12438 Midpointe Drive, about 11:30 a.m. Sunday in Brandon. He was charged with lewd and lascivious battery and violating probation.
Bogun's sister and a relative of the girl saw the two in bed asleep and naked, an arrest report states. The girl's age wasn't listed in the report.
The girl told investigators she and Bogun had sex, and a nurse examiner indicated there was evidence of intercourse, the report states. Bogun told investigators he and the girl, whose name he said he doesn't know, were in bed fully dressed and never had sex but "might have touched briefly when sitting next to each other earlier."
Bogun remained in Orient Road Jail on Monday. His bail had not been set.
Uncle Of Accused Shooter Charged With Battery
James Seay's family vigorously defended the 18-year-old last week after his arrest in the shooting of a St. Petersburg undercover officer, but now one of his uncles is in trouble with the law, Gulfport police said.
Carl Seay, 50, was arrested Sunday on charges of domestic battery, false imprisonment and depriving a person of the use of 911, Lt. Robert Vincent said.
Police were dispatched to a 911 hang-up call at 4926 10th Ave. S., and one officer heard a woman inside the home yelling "get off me" and "help me," Vincent said. Officers kicked open the front door.
Carl Seay is accused of hitting his live-in girlfriend in the face, ripping hair extensions from her head and pulling her earrings out. He also threatened to kill her if she left the house and pulled the phone cord from the wall while she was calling 911, Vincent said.
James Seay is charged in the shooting of an undercover detective after a gas station robbery. The detective survived.
