A 32-year-old lunchroom aide at Spoto High School has been suspended without pay after acknowledging, according to the Hillsborough County Sheriff's Office, that she had an inappropriate relationship with a student.

Yenisy Rodriguez of Tampa was suspended, effective Wednesday. Criminal charges have not been filed against the five-year Hillsborough school district employee, but a formal recommendation of termination is pending.

The Hillsborough state attorney's office is reviewing the case, office spokeswoman Pam Bondi said.

Rodriguez said Thursday that she was told there were no criminal charges and the case was closed. She declined to comment further.

The student, whose name and age were removed from a sheriff's office report, told two teachers last month that he had been romantically involved with Rodriguez, who is married, the report said.

That triggered a sheriff's office investigation in which Rodriguez said text-messaged the boy and, on one occasion, hugged and kissed him as they sat in her car outside his house, according to the report.

Rodriguez told authorities it was a "misunderstanding," that "at no time has she ever had a relationship with a student at any school she worked at," the report said.

The aide told deputies, they say, that she met the boy in the spring during lunch at Spoto, 8538 Eagle Palm Drive in Riverview. They talked about Cuba, their homeland. The next day, the boy gave Rodriguez his phone number, and she called him in the afternoon, she told deputies.

He was having a tough time in the United States, deputies say she said, which prompted her to text him and call him frequently. She and her husband befriended the teen, she said, even buying a pass for him to go to Busch Gardens with them.

The boy told authorities a different story.

He said they had phone sex first and then had sex in her car near his house. That happened about four times in April, sometimes before Rodriguez took him to school, he told deputies.

Rodriguez rented an apartment near U.S. 301, the teen said, and he moved in with her for a few months during the summer. He said his mother found out about the relationship in June and "was not happy about the situation," the sheriff's office report states.

The boy's stepfather contacted authorities and told them he didn't believe the boy's accusations. He thought the boy lied because he wanted to have a relationship with Rodriguez and she didn't want one.
