Judge remains in officer slaying case

A judge whose husband was a Tampa police sergeant will continue presiding over the case of a man accused of killing a Tampa police corporal.

At a hearing Monday, neither defense attorneys nor prosecutors called for Hillsborough Circuit Judge Denise Pomponio to recuse herself from the first-degree murder case of Humberto Delgado Jr.

Delgado has pleaded not guilty in the slaying of Cpl. Mike Roberts. He is accused of shooting Roberts after a brief struggle on Aug. 19 near Nebraska Avenue and Arctic Street.

Authorities said Roberts was trying to question Delgado after seeing him pushing a shopping cart in an area that had experienced a rash of burglaries.

At Delgado's arraignment last week, Pomponio notified attorneys that her husband, Peter, served with the Tampa Police Department from 1979 to 2004.

She scheduled a hearing to discuss whether that would pose a potential conflict of interest.

Delgado was present for the brief hearing, as were Roberts' widow, Cindy, and 3-year-old son.

Pomponio scheduled another hearing in the case for Oct 16.

Delgado, 34, a former police officer and U.S. Army private, has been held without bail in the Orient Road Jail since his arrest.

In addition to the murder charge, he faces charges of aggravated assault of a law enforcement officer, carrying a concealed firearm and depriving an officer of means of protection or communication.
