The son of Pinellas-Pasco State Attorney Bernie McCabe was arrested this morning in Plant City, accused of drunken driving.
Patrick Thomas McCabe, 24, of Largo, was arrested at 5:41 a.m. at the intersection of Stanley and Miley roads after driving into a fence, according to the Hillsborough County Sheriff's Office. Booked on a charge of driving under the influence with property damage, he was released just before 2 p.m. after posting $500 bail.
His blood-alcohol level was 0.168, according to an arrest report. State law presumes a driver to be impaired at 0.08.
McCabe said he had spoken this afternoon to his son, an employee at Big Lots.
"I don't have anything to say about it," Bernie McCabe said. "It will take care of itself in due time."
"I wish it hadn't occurred."
Hillsborough County State Attorney Mark Ober's office will handle the case, based on where the arrest was made. Bernie McCabe's office won't be involved.
Here's what the arrest report says happened:
Patrick McCabe was driving a blue Ford Taurus on Miley Road when he drove through a stop sign, ran off the road and crashed into a chain-link fence.
The crash caused an estimated $1,000 in damage to the fence and $1,000 in damage to the car.
When a deputy showed up, he saw McCabe backing up the car. Then he got out.
Deputies described McCabe's eyes as red and watery and said he was walking unsteadily and that his breath smelled of alcohol, according to the arrest report.
McCabe refused to perform the walk and turn exercise used to determine if someone is drunk, the report states.
He agreed to stand on his leg and touch his finger to his nose. Those tests indicated he was drunk, according to the report.
