Glossary of Terms:
DEFAULT Lender notifies owner of intent to sue to recover property. This is typically done after the owner misses three consecutive payments.
AUCTION If delinquent payments continue, the property is offered for sale at an auction. Lenders first give public notice of the auction.
REPOSSESSION If the auction is unsuccessful, the lender takes control of the property and attempts to resell it.
LIS PENDENS Latin for “a suit pending,” this is a notice filed in court that informs the defendant and the general public of a potential claim against a piece of property.
